Privacy Policy

Effective as of June 25, 2004

The Office of Admissions of the State Bar of California ("State Bar") and Xap Corporation ("Xap"), which operates the State Bar online application system (the "System") on behalf of the State Bar, recognize and respect the privacy interests of the System users. The State Bar is committed to protecting that privacy and keeping users informed about the privacy policy applicable to the System.

As the System evolves, we may update this privacy policy statement to reflect changes in the manner in which we deal with personal information, whether to comply with then applicable regulations and self-regulatory standards or otherwise. The privacy policy posted here will be kept current. We encourage you to review this statement regularly.

System Privacy Policy and Its Exceptions

Except as set forth below, personally identifiable data you enter on the account creation page and the online registration and examination applications are not made available or distributed to third parties. In particular, the State Bar and Xap will not give, sell or provide access to your personal information to any company, individual or organization for its use in marketing or commercial solicitation or for any other purpose, except with your express consent, at your direction, as is necessary for the operation of this site, or pursuant to one of the exceptions listed below.

Exceptions to the Privacy Policy
There are limited exceptions to the System's privacy policy. When required by law to comply with any valid legal process such as a search warrant, subpoena, statute, regulation or court order, the State Bar or Xap will supply such information contained in your registration or online examination application as that organization reasonably determines, based on the advice of counsel, it is legally required to supply. In addition, the State Bar or Xap may release specific information relevant to special cases, such as a physical threat to you or others or an attempted breach of security on the System site.

The Personal Identifying Information We Collect

The System collects personal identifying information from you including, but not limited to, your name, date of birth, address, e-mail address, telephone number, place of birth, mother's maiden name, sex, ethnicity, law school(s) and undergraduate school(s) attended, dates of attendance, admission to the bar in other jurisdictions, the dates of any such admissions, the status of any other bar membership and such additional information that you provide on the online registration and examination applications that you complete.

Reasons We Collect Your Personal Identifying Information

The System collects personal information from you for three reasons. The first reason is to perform a task on the System, such as filling out a registration or examination application, requested by you. The second reason is to enable you to submit in a convenient and efficient manner information that is likely to be needed when you complete the registration or examination application. The third reason is to enable the Xap to respond to your questions or contact you when necessary in connection with the functioning of the System. When the effective functioning of the System does not require personal information, none is collected.

When you log on to System, your browser will automatically transmit to the System's server the IP address of your computer and type of browser you are using. Although your browser transmits the IP address of your computer, the System does not associate this IP address with any personally identifiable information regarding you. The System does not collect any personally identifiable information other than what users submit and their browsers transmit.

Minimum Age fo 13 Required to Establish an Account

The System will not collect any information from persons who are not yet 13 years old. If you are under 13 years of age, you are not authorized to create an account on the System.

Ways In Which Personal Identifying Information May Be Used

The System will use your personal identifying information to complete the following forms for you and to effect transactions on your behalf, in each case only upon your instructions to do so:

  • Registration
  • Application to Take the California Bar Examination
  • Application to Take the First Year Law Students' Examination

Your personal identifying information may also be used for the following purposes:

  • We may use your identifying information to help diagnose problems with System's server and to administer the System's website.
  • Summary data representing a compilation of aggregate data representing System users may be collected by Xap and provided to the State Bar. NO PERSONAL IDENTIFYING INFORMATION IS MADE AVAILABLE AS PART OF THESE SUMMARY REPORTS. Some examples of summary data are the number of monthly visitors to the site, or the number of online registrations completed or examination applications submitted.
With Whom Personal Identifying Information May Be Used

Data you enter on the System will be available to those employees of Xap who require such access to administer and maintain the System or to provide requested customer support to users of the System. Each Xap employee who has access to the data residing on the System server has agreed in writing to respect the privacy of all such personal data. The data you enter on the System will also be made available to the State Bar but only if you complete a registration or submit an examination application.

Security Measures to Prevent Misuse of Information Entrusted to the Online Application System

The System causes the data you input to be encrypted when in route between your browser and the System server and when in route between the System server and some other browser or server. This practice helps prevent unauthorized third parties from intercepting and gaining access to your private data during transmission over the Internet. The online application system uses 128-bit, Secure Socket Layer encryption supported by both Netscape's and Microsoft's browsers.

Data residing on the System server is password protected, and access is provided only to the account holder who created the password, anyone to whom that account holder entrusted the password and, as indicated earlier, those employees of Xap who require such access to administer and maintain the System or to provide requested customer support.

Notification Policy for California Residents

In the event Xap reasonably believes that your unencrypted personal information has been accessed by an unauthorized person, Xap will notify you promptly regarding such unauthorized access, unless notification is delayed at the request of law enforcement agencies to avoid impeding a criminal investigation. Such notification will be made by e-mail, unless Xap does not have a valid e-mail address for you, in which case notification will be sent by United States mail to the home address indicated in your user account. For this purpose, personal information means (i) your first name or first initial, (ii) your surname and (iii) at least one of (a) your Social Security number, (b) your driver's license or alternative identification card number, or (c) a financial account number, credit card account number or debit card account number associated with you, in combination with any required security or access code or password needed to access such account.


A "cookie" is a small file that a website transfers to a user's computer, which may then be stored on its hard drive. The System uses cookies to remember you and personalize your web-viewing experience by keeping track of your session when logged on to the System. Cookies enable you to maintain continuity as you move from page to page on the System and to avoid the nuisance of being asked to provide the same information repeatedly. Cookies also allow us to make sure that only your browser can exchange information regarding your account with our servers. Cookies cannot be used to steal personal information or to gain access to information that you did not directly provide. The cookies we use are set when you log on to the System and are erased when you log off from the System or completely close your browser. Your browser must be set to accept cookies in order for the System to function properly.

Modifying and Deleting Your Information

Once a registration or an application for a specific examination is submitted, information cannot be changed or deleted online. If you would like to modify or delete information you provided in your registration or in a submitted examination application, please write to the State Bar's Los Angeles Office of Admissions specifying the changes you want to make. If you apply for a future examination, you may modify or delete from the data stored on the System any information you previously provided. To modify such data, (i) log on to the application in the System for the examination you are then planning to take, (ii) go to the screens containing the information you want to change or delete, and (iii) modify that information using standard word-processing techniques. You may change, but not delete, information that is required. To delete non-required information, (i) log on to the System, (ii) go to the screens containing the information you want delete, and (iii) delete the information you want to remove from the System using standard word-processing techniques. Please recognize that if you delete information, it will no longer be available to be used in additional applications on the System. Similarly, information that has been updated or otherwise modified will appear in applications submitted subsequent to the modification in its then most current form, rather than in the form in which it may have been submitted at some earlier time.

Amending This Privacy Statement

The State Bar may amend this Privacy Statement from time to time. If State Bar makes any substantial change to this Privacy Statement concerning use of your personal information, the State Bar will post a message regarding the change on the System homepage.
